According to the ESI Act 1946, all the establishments are eligible to provide the ESI Registration and also fulfill all the employee's ESI criteria in that state. The Firms covered are given below, • Shops • Cinema's • Movie Theater • Medical Institution • Hotels & Restaurant • Newspaper establishments • Private Educational Institutions • Roadside motor transport establishments Hotels & Restaurants are compulsory to offer the service only, not have other manufacturing functions. Medical & Educational institutes are not under the Act in some states. For newspaper establishments, in that no coverage in the Factory Act.

Eligibility for ESI Registration in India

First of all the major eligibility for ESI Registration, which is the establishment should have a minimum of 10 members or above. In some states, ESI should apply for the establishment having a minimum of 20 members. Other ESI eligibility criteria are,  Any employee, whose gross salary is up to Rs.21,000/month, can get that with the guidance of the employer.  The establishment should register with EPFO.  The combination of the ESI is 6.5% of the gross salary, it was divided as, 1. By the Employer - 4.75% 2. By the Employee - 1.75% For Industrial units, there are any chances for injury or health Issues at the business establishments, all employees with salary less than Rs.21.000 mandatorily require to get ESI.

To register the Employee State Insurance (ESI), the employer should submit the below provided documents.

Identity Proof

Registration Certificate/license provided by,

  • Shops & Establishment Acts
  • Factories Act

Address proof

Rent Receipt of the business premises should provide capacity

  • Copy of PAN card
  • Copy of Bank Statement
  • Photocopy of the last building TAX/Property TAX receipt
  • Memorandum and Articles of Association (MOA & AOA)/Partnership Deed/Trust Deed dependent on the applying Firm.

Each employee, a monthly pay sheet is needed for computing contribution amounts for ESI Filings.

ESI Due Dates

  • Payment: 15th of every month
  • Returns: 11th May & 11th November

PF Due Dates

  • Payment: 15th of every month
  • Returns: 25th of every month

An Annual payment of Rs 120 of medical care, is available for the retired employee or those who are opting for VRS/ERS. Insured ESI members retiring in the case of permanent disabilities, can qualify for the same benefits.

Extended Sickness benefits

Incase, ESI members suffering from Chronic Diseases, can get the benefits of Extended Sickness leave. Which will also provide, if you already have taken 91 days to leave. There are the conditions applied to get that benefits, it was concerned ESI Member must working in the company at least 2 years at the onset of the sickness & its consecutive diagnosis.

Enhanced Sickness benefits

Enhanced Sickness benefits were introduced in 1976 as a measure to encourages the ESI employee to undergo Vasectomy & Tubectomy for the family welfare. If the ESI members interested to get sterilization procedures to have the eligibility to utilize the Enhanced Sickness benefits of their daily average wages. This benefit also provides the recovering period for both Vasectomy (7 days) & Tubectomy (14 days) from the date of admission hospital or date of surgery. Extension of this advantage also for the postoperative complications.

Criteria for Filing Returns after the Filing of ESI Registration

ESI returns filing is compulsory 2 times a year, along with that should submit following documents,  Attendance Register of employees  Wages Register  Form-6 register  Monthly returns & respective challans  Registration of any accidents takes place within the business premises.
